Shouldn’t have any more problems with KAMPA & KOMPANY’s unethical reconfiguration of the Lake Don Pedro Community Services District into a GROUNDWATER SUBSTITUTION FACILITY circumventing restrictions in WL11395 to continue expanded SPECIAL BENEFIT water service to properties OUTSIDE THE MERCED IRRIGATION DISTRICT PLACE OF USE for MERCED RIVER WATER.  

{Properties and major project proposals with which Pete Kampa was co-incidentally involved 20 years ago when starting his infamous water career which has apparently involved exploiting the water resources of various other communities as well.  Humm, likely just another strange coincidence.}

What about meaningful discussion of legitimate district issues at monthly public meetings with our elected and appointed officials?

Hey! – recall Board President Danny Johnson’s repeated advice to questioning customers at meetings?

Have those subjects placed on the agenda for the next monthly meeting discussion and possible action.

(Because, as we all know by now, if not an “official agenda item” the Board of Directors and management are prohibited from participation in any discussion due to their steadfast adherence to applicable rules and regulations <choke> almost squirted Mtn Dew out both nostrils on that one.  lol)

Sure, it is true that this suggestion has failed in the past, but maybe, just maybe, it will work this time?  Nothing ventured nothing gained, eh?

Sure wish I had not bet all that money, marbles and chalk they would. – lol

Heck, even if one made it to the agenda (like last time) the Board President will just avoid “unwanted” discussion by skipping right over the item with his & KAMPA’s “jump around the agenda” method while sporting some feigned forgetfulness or distraction that is almost believable except for the regularity with which they occur.

Apparently there is something wrong with Danny Johnson’s suggested process in solving this long standing problem of the Board and management being regretfully unable to discuss legitimate issues with customers at monthly meetings because the item is not on the agenda…… but,… but, … but…….wait a sec……..this is so darn confusing……aren’t…..aren’t  ……Danny Johnson and Pete Kampa the individuals who determine WHAT GOES ON THE AGENDA?…..So,  so, if they wanted to discuss a particular matter at an upcoming meeting …. surely they could have it placed on the agenda, right?

So, what you’re suggesting is “they”, being the Board of Directors and their appointed GM/TREASURER, really do not want to discuss certain subjects and are only using the “not on the agenda excuse card” to avoid discussion and potential accountability for their actions as public officials which continue to harm the far majority of innocent <MR WECs> in the subdivision?

Imagine that.  An excuse?  Go figure.

Sure wish “WE” had attorneys (and other professional support organizations) paid for by someone to represent the deteriorating position of MERCED RIVER WATER ENTITLED CUSTOMERS <MR WECs> of the subdivision.  Funny how that works huh?  <MR WECs> pay for the majority of these professional services that end up representing and protecting the contrary special interests of a “for profit management company” president appointed LDPCSD General Manager and Treasurer by the Board of Directors?

A GM/TREASURER whose 20 year old personal and business motivated decisions are simply rubber-stamped by a supporting Board of Directors (who also refuse to answer questions) thus leaving the far majority of <MR WECs> of the subdivision in the dark – rather like mushrooms awaiting harvest?

We have certainly been fed a lot of KAMPA KRAPA since 2014.

Public officials refusing for years to discuss

  • public business,
  • during public meetings,
  • with their paying public, and steadfastly 
  • refusing to answer legitimate questions as to district activities which are harming the majority of legal MERCED RIVER WATER ENTITLED CUSTOMERS?

Isn’t the above some kind of clue as to the absurdity of “community accountability”?

BELOW is what I “hand-submitted” to the LDPCSD long before the “due date” for agenda requests by the public.   Actually, this request was accepted/stamped on Tuesday, July 25th, but I entered the office just before closing and the date stamp had already been changed in preparation for the next work day which would have been Thursday, July 27th.  No biggie – makes sense to prepare for an anticipated busy Thursday morning, just wanted to explain the discrepancy between my hand-written date on page 3 and the “received” stamp date.

While cleaning up files and folders on the computer I discovered some abandoned projects and picked up where I had left off on a couple. (Sometimes I”ll open a file with an idea knowing there is not enough time to complete the task but the file serves as a later reminder to follow up on a particular concept. Kind of just playing around with the different features of the software actually. Little by little I’m figuring out some things that had previously eluded me.) Later!

UNPLEASANT TASK

 

 

We had been quietly battling over homeland turf for decades with each side determined and committed to a superior claim of residency.  Several months, even years could pass without notable incident until a sudden upsurge in looting and theft signaled the necessity for more drastic measures.  Rather cyclical actually.

Our side had a clear technological advantage with resulting daily reclamation of night-lost ground but they possessed greater numbers with little question of dominance over the darkness.  They appeared relentless despite occasional heavy losses and almost ghost-like – simultaneously everywhere and nowhere leaving little clue for successful elimination.   Each glimmer of hope for head on eradication was ultimately dimmed with a resulting robust and defiant insurgency.

So it continued until realizing it was not the type of warfare that required adjustment but rather my attitude and absolute commitment to winning.   I had to be just as relentless and determined, perhaps even unfeeling in some respects, if that was possible.

There was no more room for any semblance of sympathy or compassion for my adversary.  Whatever “right to existence” I may have possibly imagined or considered had no legitimacy under the current circumstances.  It was “now or never” because the situation was unsustainable as is.  No half measures could be permitted to unintentionally assure minimum survival with the inevitable slow escalation in disruption and constant threat of eventual permanent co-habitation beyond any hope of removal.   I had to be tough for my own health and survival and those under my charge.  I was making excellent progress believing any residual compassion for their plight was also on the verge of complete annihilation until once again being reminded, regardless of form, it is all a miracle.

BLACK HOLES OF THE LAKE DON PEDRO CSD

 

 

So many peculiar coincidences seem to orbit around the LAKE DON PEDRO COMMUNITY SERVICES DISTRICT.

Well, wait a sec… not coincidences exactly, although the LDPCSD has certainly exhibited many of those through the years, but more like small but extremely powerful vacuums, or ….  black holes.  Yes that’s it, black holes.

You know, like in the universe where the black hole gravity is so strong not even light can escape.  A singularity where only a thin ring of light is observable as everything is sucked into the black hole darkness.  Yeah, black holes, that’s more accurate and descriptive.  Little “black holes” that constantly orbit around the LDPCSD environment and protect sensitive issues.  Black holes that crisscross back and forth monitoring and searching for any semblance of complaint or question regarding the decades of unethical activity our public agency has pursued on behalf of speculative land developers not entitled to MERCED RIVER WATER service as is the Lake Don Pedro subdivision.

And when these black holes encounter such questions and/or complaints? 

Whoosh! 

All neatly vanish into a dark unknowing realm, out of sight, ignored and eventually forgotten until the next time the process is repeated again, and again, and again but always to the same inevitable conclusion—–

no answers to legitimate questions while institutionalized fraud continues unchecked.

However, differing from the traditional concept of a black hole in space which consumes everything including light, the

LDPCSD Black Holes devour anything that might shed lighton the truth!

 

The “powers that be” certainly do not want the <MR WECs> of the subdivision to understand their designed and critical roles as perpetual financial victims.

RECALL my last attempt to escape these “defensive truth gravity wells” to obtain some legitimate assistance?

Anyone care to take a wild guess as to what happened to that detailed complaint sent to the Sheriff’s Office on June 30th, 2017 (and later publicly posted on this website on July 3rd, 2017 when no acknowledgement of receipt had been received yet)?

If your reply was “A BLACK HOLE ATE IT“, you might be correct.

Regardless, I waited for the semi- conclusion of the Detwiler Fire Emergency to check on the status of the complaint, but was advised on Tuesday, August 1, 2017 by a Mariposa County Sheriff’s sergeant that the individual responsible for communications through “sheriff@mariposacounty.org” stated the material was never received.  Would I resend it?

I asked if his statement was a joke – confirming it was not –  you bet I’ll resend it!

Strange, I was never notified through my email service that the communication was undelivered (like when you mistype the address or the destination no longer exists).  I wonder what sort of E-communication tracking is available for such a law enforcement/county government email address?  I would suspicion there is a record of everything sent and received through that address somewhere –  considering the potential for extremely important information being relayed.  How often does information sent to that address get lost somehow?  How would they know if there was no follow up by the sender?  How could government officials confirm and reassure the public that critically important information sent to this address was not being lost or “hi-jacked” from delivery to the intended recipient?  I would be very surprised and disappointed if there were not some sort of electronic accountability for such government communications in this day and age of technology.

SAVED A FEW DOLLARS THIS TIME

Well at least I did not have to hand deliver it like the information request to the Merced Irrigation District that was somehow lost between Sacramento and Merced.  Imagine, a USPS certified letter with a request for information regarding the MERCED RIVER WATER COMPLIANCE REPORTING the LDPCSD has done for 17 years mysteriously lost with no explanation. (Stranger still is the fact that Pete Kampa with all his LDPCSD experience wasn’t aware of such reporting requirements?  Sorry, highly implausible.)   Then later, after receipt of the “walk-in request” for the information the MID still wasn’t sure what I was requesting.  17 years of reporting and no clue as to what I was requesting?  Stranger still, eh?

OK – I’LL RESEND TO THE MARIPOSA CO SHERIFF’S OFFICE w/BONUS

I resent the five pages of material outlining my fraud complaint (same address as before: sheriff@mariposacounty.org) and this time received confirmation it was received.  Considering the circumstances I decided it might be prudent to forward the original complaint to the Mariposa County District Attorney’s office as well.   They acknowledged receipt!

There are curious aspects as to the complaint not being received by the sheriff’s office along with confusing subsequent statements as to the complaint’s prior investigation, determinations made, by whom, and the current complaint status which I am anxious to follow up on.  However, in all fairness to the district attorney (now involved with the forwarding of material),  I believe withholding my traditional up to the moment emotional blah blah blahs for a while might also be prudent, if for no other reason than simple courtesy and respect for the District Attorney.

 

We shall see.

MISREPRESENTATION of the LDPCSD IS NOT FUNNY

 

 

 

 

 

 

 

I believe the below statement by Pete Kampa at the July 17th, 2017 Board Meeting is important in understanding how our surface water treatment plant has been reconfigured with public funds for the purpose of providing expanded special benefit water service to private third party land developers outside the MERCED RIVER WATER place of use per water license 11395.

What has PETE KAMPA been advocating to state legislators regarding the LDPCSD’s special benefit water service for the last 20 years?

You will recall such OUTSIDE Place of Use water service is accomplished through a GROUNDWATER SUBSTITUTION PROGRAM where every unit of MERCED RIVER WATER delivered outside the permitted SUBDIVISION & GOLF COURSE area must be replaced with an equal or greater amount of groundwater obtained from expensive groundwater wells which were developed with district and grant funds – all of which are, of course, considered PUBLIC FUNDS.   This naturally raises the question:

why should the <MR WECs> of the subdivision pay for this special benefit water service?

Following Director Russ Warren’s statement of appreciation for the California Special Districts Association’s (CSDA) weekly 2-3 emails sent updating various state water issues, LDPCSD Board Vice President Dan Hankemeier advised that Pete Kampa deserved credit for his efforts – as none of it would have happened without him.

I wholeheartedly agree – but from a completely different and adversarial perspective.

Indeed, none of what has happened within the LDPCSD could have occurred without

Pete Kampa and his influential connections within the legitimate government process.

 

Pete Kampa made the following statement supporting the CSDA and its affiliates:

“Yeah so, been a ah been a long time on the CSDA board as well, watch, watching these programs evolve.  They’re very, very helpful to, to districts and ah, it continues and it never goes away.  You know …. having to educate the legislators about what what goes on, what decisions we make and the important issues we deal with.  CSDA is the prime vehicle to get that, get that word there  so its very much appreciated and ah the position that Dane holds did not exist a decade ago ah, that was a big decision on part of the [CSDA] board [where KAMPA has been a DIRECTOR for almost 20 years] to put the leadership ah, ah put the leadership support into the communities because that’s one of the biggest things getting……how else are you going to know what’s going on in Don Pedro unless you are right here, they don’t televise the meetings ah, and so, anyway thank you Dane.”      

 ? ? ?

Seriously, think about the above statement and the near two decades Pete Kampa has spent on that CSDA Board of Directors cultivating the receptive ear of legislators involved with state water policies for special districts such as ours.

Can you imagine almost 20 years of special interest representation and influence on decisions by elected representatives in Sacramento (and else where) who have been intentionally provided incorrect information regarding the LDPCSD and who knows what else?

[ Makes me think of that extremely detailed 1987 LAFCo report supporting the LDPCSD’s expansion of water service boundaries and sphere of influence by thousands of acres outside the subdivision WITHOUT ONE MENTION OF THE MERCED RIVER WATER RESTRICTIONS CONTAINED IN WATER LICENSE 11395 UNDER WHICH THE LDPCSD LEGALLY PUMPED WATER FROM LAKE McCLURE FOR DECADES!

Just a simple “over-sight”?

LIKE ALSO FAILING TO MENTION THE MANY GROUNDWATER WELLS BOISE DEVELOPED AND LATER ABANDONED DUE TO INADEQUATE AND POOR WATER QUALITY PRODUCTION?  IF GROUNDWATER SUBSTITUTION DIDN’T WORK FOR THE ORIGINAL DEVELOPER BOISE CASCADE  – WHY WOULD COUNTY LAFCOs LATER SADDLE INNOCENT LAKE DON PEDRO SUBDIVISION PROPERTY  OWNERS WITH THAT SUBSTANTIAL FINANCIAL RESPONSIBILITY THROUGH MANY DISTRICT ANNEXATIONS  – and, WITHOUT REQUIRING A PUBLIC NOTICE DISCLOSURE OF THE LIABILITY INVOLVED WHEN PURCHASING A LAKE DON PEDRO OWNERS ASSOCIATION lot?

I think not.

These issues (and others) were intentionally ignored FACTS WHICH SHOULD HAVE SUPPORTED THE 1985 MARIPOSA COUNTY PLANNING DEPARTMENT SUGGESTION OF A ZERO SPHERE OF INFLUENCE for the LDPCSD! 

Yet the opposite happened…..EXPAND…..EXPAND…..EXPAND……THE DISTRICT SERVICE AREA

and let the innocent  <MR WECs> pay for it for perpetuity. ]

AND IN SACRAMENTO?

Decisions made by otherwise legitimate government officials who were honestly attempting to do what was best for the “public they serve”, yet their decisions were based on extremely selective, one-sided, and self-serving information provided by organizations such as the CSDA with representatives like Pete Kampa who pursued “private water interests” with public resources and funds?

I wonder how many other CSDA Board Members also have their own for profit special district limited liability management companies on the side?  Wonder if they have a “conflict of interest” type code of ethics for their members whose private business opportunities could conceivably be affected by some of the CSDA programs which recommend changes in operation of particular special districts?  I have no idea and am apprehensive to start researching the CSDA after seeing that “may be hacked” warning for one of their websites.  Besides, would it really matter?   Apparently rules are intended to be broken by those “above the law”, right?  So regulations don’t matter.  Heck, take another look at the MERCED RIVER WATER POU restrictions in WL11395 which have been ignored for decades.  SO many examples.

Pete Kampa was a former LDPCSD employee with a MERCED RIVER WATER outside Place of Use “CHIP ON HIS SHOULDER” acquired during his first tour of employment between the years 1994-1997 following public discovery of his wrongful attempts to greatly expand district water service outside the water license permitted place of use (residential subdivision and golf course).

KAMPA was returned to the LDPCSD in October 2014 through a board orchestrated and highly unethical closed recruitment process guaranteeing his appointment as GM and BOARD TREASURER WITH ACCESS TO OVER $1 MILLION IN SAVED DISTRICT CASH COMPLIMENTS OF A REQUIRED PROP 218 JUST TO REMAIN SOLVENT AFTER A NEAR BANKRUPTCY!

Our nonprofit LOCAL PUBLIC AGENCY (with its hard saved million dollar cash bank account) was turned over to a former disgruntled LDPCSD employee (who now had his own for profit limited liability management company on the side) for the specific purpose of completing the district expansion KAMPA started 20 years earlier through the creation of a larger GROUNDWATER SUBSTITUTION PROGRAM though development of groundwater wells with public funds.   (Public funds used to increase the profit margins for private land development interests wanting subdivision water.)

Kampa was returned to the LDPCSD with NOT ONLY the support of local land developers demanding water service, but also with two decades of experience within the CSDA along with the many “government contacts” with which that organization encourages access and communication.

Seriously, what chance do complaining victim LDPCSD customers have when their own “legitimate state representatives” have been provided incorrect information for decades by those representing the contrary special interests of third party land developers demanding subsidized water ?

 

I do not think this is funny what-so-ever as it is an excellent example of how “behind the scene activities” can circumvent and corrupt the legal process of government agencies honestly attempting to serve the needs of those entitled tax paying citizens.

Transparency Award?

Oh please. Only another attempt at concealing what KAMPA & KOMPANY have been quietly doing since Oct 2014, which is – deceiving the MERCED RIVER WATER ENTITLED CUSTOMERS  <MR WECs>  of the LDP Subdivision while expanding a GROUNDWATER SUBSTITUTION PROGRAM for land developers outside the legal Place of Use for MERCED RIVER WATER. Those who receive a special benefit should pay for that special benefit – not the innocent property owners of the residential subdivision.

Pete Kampa apparently incorrectly documented the name of that California Special Districts Association (CSDA) representative who  presented the TRANSPARENCY AWARD during the July 17th, 2017 LDPCSD Board meeting.  Having had limited experience with umlauts in a German language class I took many years ago, I decided to check why the name sounded so much different than had been reported in Pete Kampa’s written GM report.  Sure enough, Pete left out the umlaut over the “e” in Wadle’.  (Sounds like Whadley with the umlaut.)  I was able to confirm this by looking Mr. Wadle’ up on the CSDA website — the below links are OK, but be careful, one of the other sites identified on a CSDA search is marked as “hacked”.
